COZUMELITOS TOURS WELCOMES YOU, AND THANKS YOU FOR YOUR PREFERENCE, INFORMS YOU AND INVITES YOU TO HAVE PRESENT that:


  • The terms “ COZUMELITOS TOURS ”, “ COZUMELITOS TOURS.COM , “we” and “our” refer to COZUMELITOS TOURS , domiciled in Mexico, with address at Selvanova 508, Playa del Carmen, Quintana Roo. The term “You” refers to the user of the services offered by COZUMELITOS TOURS through the website. www.cozumelitostours.com and/or the COZUMELITOS TOURS application for cell phones and/or smartphones and/or through any other marketing channel currently used or that COZUMELITOS TOURS may use in the future. to offer Services (the “Platform(s)”).
  • COZUMELITOS TOURS is an online travel agency, whose technological platform allows a large number of tourism service providers (the "Provider/s") to offer and market their services to users, who in turn can seek inquiries about flights, accommodations, cars, cruises, activities and other tourist services (the "Tourist Service/s"), compare and reserve said services in real time, and acquire them separately or combined, putting together and managing their own trip, according to their personal needs.

  • COZUMELITOS TOURS is not the provider of the Tourist Services and acts on behalf of and for the Providers, and is therefore not obligated—directly or indirectly—to provide the Tourist Service. When you contract Tourist Services through COZUMELITOSTOURS.COM , you are entering into a contract directly with the Provider who offers their Tourist Services through our Platform. COZUMELITOSTOURS.COM acts as an intermediary between you and the Tourist Service Providers, acting on behalf of and representing the Provider.
  • By contracting Tourist Services through COZUMELITOSTOURS .COM , You guarantee and declare under formal protest of telling the truth that: (i) You are of legal age; (ii) You expressly accept these Terms and Conditions, which You have fully understood and expressly consent to use electronic means; (iii) You have full capacity to enter into contracts; (iv) You only use the COZUMELITOS .COM Platform to reserve or contract Tourist Services for Yourself and/or for another person for whom You are authorized to act; (v) in the case of acquiring services with a destination/stopover in Cuba, You are not a citizen or resident of the United States, nor are You subject to the jurisdiction of the United States; and (vi) all the information You provide to COZUMELITOS TOURS is true, accurate, and current.
  • These general terms and conditions apply to the intermediation services provided by COZUMELITOS TOURS . They do not, in any way, replace or modify the legally established liability limitations in your country of residence, nor the special conditions that each Tourism Provider has defined for its Tourism Services. Before contracting, please review the specific conditions of each Tourism Service and each Provider. COZUMELITOSTOURS.COM is not responsible for , nor has any influence over, the specific conditions established by each Provider for the provision of its Tourism Services.
  • You expressly understand and accept that COZUMELITOS TOURS 's intermediation activity in the marketing of Tourist Services does not guarantee that the chosen destination does not present risks to the health and integrity of people. COZUMELITOSTOURS.COM is not responsible, either directly or indirectly, for any damages or losses that you or those traveling with you may suffer in any way before, during, or as a consequence of the chosen destination. COZUMELITOS TOURS is not responsible for events arising from unforeseen events or force majeure, including weather phenomena, acts of nature, labor disputes, among others, that may occur before or during the provision of the Tourist Service, and that may eventually delay, interrupt, or prevent its execution.
  • Before confirming your purchase request and after expressly accepting these General Conditions (the "Purchase Request"), we advise you to directly review the specific terms and conditions applicable to the Tourist Service you wish to contract. This will avoid surprises and allow you to enjoy your trip as planned. The terms and conditions of each Tourist Service are established by each Provider without any interference from COZUMELITOS TOURS . It is specifically clarified that COZUMELITOS TOURS has no influence whatsoever on the collection of penalties by the Providers or on any rate differences, if applicable, which will depend on the terms and conditions of each Provider.
  • The sole use of the Platform implies acceptance of each and every one of the general and specific conditions included in these terms and conditions, which are considered an adhesion contract, even if this document does not contain all the ordinary clauses of a contract. Reading and understanding them will allow you to better exercise your rights as a consumer. We suggest you print and keep them, along with your other travel documents. Remember to take note of the Purchase Request number that will appear on the screen when confirming your request and/or in the purchase confirmation email. This number identifies your transaction and will be essential for any clarifications and/or management through COZUMELITOSTOURS.COM .

IF YOU CONTRACT TOURIST SERVICES THROUGH COZUMELITOS TOURS , KEEP IN MIND THE FOLLOWING INFORMATION:


SECTION A – GENERAL CONDITIONS OF SERVICE :

  1. HOW DOES THE RESERVATION PROCESS WORK? When you make a Purchase Request on COZUMELITOSTOURS.COM and/or confirm the reservation request with our online sales agent, you authorize us to process your reservation and make the corresponding charges to your account or card. Please pay close attention to our subsequent telephone or electronic communications, where we will keep you informed about the progress and status of your Request. The successful completion of the reservation process and/or confirmation of the purchase depend on the full and timely payment of the price and/or rate of all Tourist Services. Until full payment of the reservation is confirmed, the Purchase Request will be suspended and may be unilaterally canceled by the Provider, without liability for the latter. Final confirmation of the Tourist Services and respective prices will occur with the issuance of the electronic ticket(s) or the sending of the voucher (as applicable) and their respective invoicing. Furthermore, for credit transactions, the requirements established by your issuing bank must be met. The issuance of the electronic ticket or voucher – whichever applies – attests to the acceptance of the Provider's terms and conditions and the execution of the contract signed between the Provider and the person whose name(s) appear(s) on said electronic ticket and/or voucher.

If the Purchase Request is subject to confirmation—a circumstance you will be informed of in the first email you receive—any amounts paid prior to confirmation will be considered a reservation. If your Purchase Request is ultimately rejected for any reason (for example, but not limited to, insufficient balance on your credit card, lack of availability, rate change, etc.), COZUMELITOS TOURS will inform you of the available options should you wish to insist on the purchase or reservation, or, at your request, will refund the amounts paid.

If you do not receive an email with the purchase information after submitting your Purchase Request, please check your spam folder and/or log in to My Account / My Reservation or My Trips on the Platform using the Purchase Request number. From there, you can manage your order and, if you have any additional questions, you can contact us at the contact numbers listed on the Platform.

  1. WHAT SHOULD BE THE PERSONAL DATA ENTERED? You must enter all fields with accurate, complete, current, and truthful information in order to make valid reservations for Tourist Services through COZUMELITOSTOURS.COM . By entering your personal information on the Platform or by providing it via telephone, you declare that said information (the "Personal Information") is accurate, precise, and true, and you undertake to update said Personal Information as necessary. COZUMELITOS TOURS is not responsible for the accuracy of the Personal Information provided by you. You guarantee and are responsible for the truthfulness, accuracy, validity, and authenticity of the Personal Information entered. Remember that all your information must exactly match the Travel Documentation as defined in section VI.
  • WHAT CONTACT INFORMATION IS REQUIRED?: You must provide an email address in the "Contact Information" section or provide it to the COZUMELITOS TOURS sales agent. This email address is our means of contact with you. Please check that the email address provided as your contact point is correct and be alert to the information that will be sent to this address. You will be deemed to have been duly informed of the confirmation of your Purchase Request or of any inconvenience or variation to it by sending this information to the email address provided by you. Please note that if the email address you provided contains any errors, you will not receive essential communications for the management of your Purchase Request. However, you can call or log in to My Account (or through My Booking and/or My Trips) and track and/or manage all your Purchase Requests from there.
  1. THAT BILLING DATA REQUIRED?: You must provide your exact tax information in the "Billing Information" section or to the COZUMELITOS TOURS sales agent so we can issue you the corresponding tax receipt. You declare that such information is accurate, precise, and true. COZUMELITOS TOURS will not be responsible for the issuance of documents with incorrect information provided by you. You guarantee and are responsible for the truthfulness, accuracy, validity, and authenticity of the tax data entered. Updating the Personal Data mentioned in point II) will not affect the billing tax data provided by you. In the event of inconsistencies between the billing data provided by you and that reflected in the sales receipt, the client may request a correction of the invoice through My Account within 30 days from the date of issue of the receipt. You may receive an invoice issued by any of the entities detailed in the header of this document and defined as COZUMELITOS TOURS or COZUMELITOSTOURS.COM .
  1. WHAT INFORMATION CAN I FIND ON THE COZUMELITOSTOURS.COM PLATFORM? The information published on the COZUMELITOSTOURS.COM Platform regarding prices, qualities and characteristics of the Tourist Services, their availability, conditions of sale, restrictions, cancellation or refund policies (among others) is established and provided by the Providers of the Tourist Services online and in real time. As an intermediary, COZUMELITOS TOURS informs you about the characteristics of the Tourist Services, manages your Purchase Requests with the Providers, collects, where applicable, the values ​​corresponding to the rates and supports you in the search for solutions in case a concern arises. COZUMELITOS TOURS will make its best efforts to provide correct and accurate information, but is not responsible for errors (such as manifest and typographical errors), interruptions (due to temporary and/or partial server outages or repairs), inaccuracies, misleading or false information emanating from the Providers of the Tourist Services. COZUMELITOS TOURS is not, and should not be construed as, an endorser of the quality, level of service, and/or rating or classification of any Tourist Service available on the Platform. We advise you to read the terms and conditions of the Providers, as well as the comments of other passengers listed on the Platform, to obtain advice on the Tourist Service(s) you choose and assess whether they meet your needs and expectations. The Platform may contain links and pointers to other websites, resources, and sponsors of the Platform. Links from the Platform (in any direction) to other third-party sites maintained by third parties do not constitute a recommendation by COZUMELITOS TOURS of any third party, their websites, or their content. Furthermore, COZUMELITOSTOURS.COM may provide tools to enable interaction between the Platform and a third-party site, such as a Social Network. COZUMELITOS TOURS is not responsible in any way for third-party sites or resources, and your use of these sites and resources will not be governed by these terms and conditions. COZUMELITOS TOURS may, at any time and in its sole discretion, access or use any profile or other information about you that you have provided to Facebook® and/or any other third-party social networking or website ("Social Network"). In such case, you expressly consent to COZUMELITOS TOURS : (i) COZUMELITOS TOURS accessing and disseminating on the Platform the information or content that is part of your public profile within the Social Network; (ii) The content of the public profile originating from the Social Network may be considered as generated by you on the Platform; and (iii) The public profile will continue to be governed by the terms and conditions and Privacy Policy of the originating Social Network.
  1. WHAT DOCUMENTATION WILL I NEED TO TRAVEL?: You have a duty to responsibly inform yourself about the legal and/or immigration documentation and/or health requirements that you or your traveling companions may need in order to travel as planned (the "Travel Documentation"). Check in advance the entry requirements for the destination and/or transit country, special conditions for visas, permits and/or passports, driver's licenses, vaccinations, permission for minors to leave the country of residence, or other document requirements, both for the destination and transit countries, even if it is a stopover and it is not necessary to leave the airport. If you require it and do not have it, make the necessary arrangements to obtain it in advance. Requirements may vary depending on the destination and/or transit country and your country of nationality and/or residence and/or the documentation with which you travel. Remember that it is your responsibility to comply with all entry and/or transit requirements and/or documentation required by the immigration, customs, and/or health authorities of your destination and/or transit country(ies).   • WHAT WILL I HAVE TO PAY? HOW DO THE PAYMENT METHODS WORK? : When you reserve one or more Tourist Services through COZUMELITOSTOURS .COM, you must pay (i) the price or rate set by the Provider, (ii) the taxes, fees and/or fiscal levies applicable to the Tourist Service and, if applicable, (iii) the management fee for the COZUMELITOS TOURS intermediation service (the "Management Fee"). Remember that COZUMELITOS TOURS acts on behalf of and in representation of the Service Provider and that the amounts corresponding to the price or rate of the Tourist Services are transferred (endorsed) to the Provider. COZUMELITOSTOURS .COM offers you different ways to make and pay for your Tourist Services reservations depending on the Service to be acquired, the Provider that provides it/them and the means of payment used. The payment methods and methods available for each Tourist Service are those reported on the Platform or by the agents prior to submitting your Purchase Request.
  • WHAT HAPPENS IF I PAY BY CREDIT CARD? Please note that when you provide COZUMELITOSTOURS.COM with your account or credit card details (using the form available on the Platform or with the online sales agent) and then accept or confirm the transaction, you are authorizing us to charge you for: (i) the rate for the Tourist Service (ii) any applicable taxes, fees and/or fiscal assessments, and (iii) our Management Fees – if applicable. If you make a reservation using the installment option and/or by credit card, please note that:
  1. The COZUMELITOS TOURS Management Fee (if applicable) may be applied in full to the first installment even if you have chosen the installment payment option for the remaining price or rate.
  1. Any interest and/or taxes that may accrue from installment payments are added to the proposed price or rate for the service, and the total is divided by the number of installments selected for payment.
  1. If you have agreed to balance-due life insurance or other charges with your credit card issuer that affect the total financial cost, remember to check with your issuer about the validity, conditions, and costs of such insurance or charges. These are naturally beyond the control of COZUMELITOS TOURS and depend on and/or vary according to the agreement you have reached with each card issuer or operator. We recommend that you familiarize yourself with the terms and conditions of your credit card before using the online payment option.
  1. If a cancellation is made after the purchase, provided that the specific conditions of the Tourist Service allow it, COZUMELITOS TOURS will not refund or be responsible for the interest generated by the original transaction, since COZUMELITOS TOURS does not receive said payments.
  1. The price to be paid may be charged in local currency (Mexican pesos) or in dollars, depending on whether the service is local or foreign. If services are charged in dollars, the charge will be made against your card's international limit. In any case, regardless of the currency used, the rate or price will be the one you were informed of and accepted by you. Remember that for international transactions, some banks and credit card companies impose certain fees, in addition to taxes, which may apply in accordance with applicable foreign law. Additionally, your bank may convert prices to the local currency and charge a conversion fee. The exchange rate used by the bank may be different from the one shown on the Platform, so you may experience a variation between the amount charged by the bank and the amount reported on the Platform. The bank determines the exchange rate and the international transaction fee. If you have any questions about the exchange rate and fee applied to your reservation, please contact your bank.
  1. Each transaction is subject to anti-fraud verification processes. One of these processes involves charging the equivalent of USD 1 to your card's dollar balance using an operating host located in England (UK). This process is intended to verify the card's identity and international validity. The charge and reversal process can be viewed on your account statement and does not generate any additional charges or costs for you, since once your identity and validity are confirmed, the charge is reversed (cancelled).
  1. For certain destinations, the Tour Service Provider may charge you directly for the Tour Service. In these cases, COZUMELITOS TOURS will inform you at the time of purchase, and you will receive an invoice issued by the Tour Service Provider. Please note that in these cases, your credit card will be charged in US dollars for the amount indicated in your payment details.

IX. ONCE A PURCHASE REQUEST IS CONFIRMED, CAN I CHANGE OR CANCEL IT? YES, I DO.


DO I HAVE ASSOCIATED COSTS?

If you request a change or cancellation outside the deadlines and procedures explained in the previous point, and as long as the specific regulation of the rate you selected allows it, COZUMELITOSTOURS.COM will process the request and follow-up with the corresponding Tourist Service Provider; however, both the response time and the final decision will be the Tourist Service Provider's responsibility.

Please note that COZUMELITOSTOURS.COM will charge a fee ("service fee") associated with the administrative management process carried out in the cancellation and/or change of the tourist services initially purchased. This fee will be ten US dollars (10 USD).

The Service Fee charged by COZUMELITOS TOURS is non-refundable. In the event of cancellation or changes to confirmed reservations for any reason, the Service Fee will not be refunded, as it corresponds to a service actually provided by COZUMELITOS TOURS. COZUMELITOSTOURS.COM.

Please note that if the service execution date is approaching, COZUMELITOS TOURS cannot guarantee that the Tourist Service Provider will issue a resolution to the issue. The procedure to be followed and the special conditions that apply to cases of changes or cancellations to a reservation confirmed by you are determined directly by the Tourist Service Providers, who may establish fines or penalties applicable to the requested changes. These conditions are available for consultation on our Platform or can be consulted with the telephone sales agent. Review them before booking and remember that there are Tourist Services that, by order of the Providers, do not allow changes and/or refunds, or do so with restrictions and/or penalties, even in cases of illness, strike, weather phenomena, etc. Remember that each Provider defines its penalties without the intervention or interference of COZUMELITOSTOURS.COM. All transactions at COZUMELITOS TOURS are carried out online and in real time. When you request a change, you are canceling a confirmed reservation and requesting a new one, which will be governed by the specific conditions applicable at the time you make the change. Therefore, in addition to any applicable penalties, there may be a fare difference resulting from the difference between the fare originally paid and the new fare, subject to fare availability at the time of the change (the "Fare Difference"). Remember that tourist fares are dynamic and depend on variables such as advance purchase, travel dates, seasonal promotions, and, in the case of flights, fare restrictions (greater restrictions, lower prices).

  1. In the case of refunds approved by the Provider, these may be made through a credit or chargeback to the same card used to make the reservation, with prior authorization from the credit card holder. If payment was made in cash and/or by bank transfer, COZUMELITOS TOURS will require your bank details to process the refund via transfer. The refund and/or chargeback periods will depend on each Provider (in the case of airlines, they are usually estimated to be between 30 and 120 days).
  1. It should be noted that Suppliers are not obligated to exempt passengers from the terms of the contract, even in proven cases of illness or physical disability that prevent them from traveling. That is, if the fare paid includes a penalty for changes or refunds or does not allow changes and/or refunds, the Supplier may charge these fees or refuse to refund the reservation cost.
  1. WHAT HAPPENS IF I DON'T SHOW UP TO USE A RESERVATION? If you do not show up to use your reservation on the date and time indicated (or arrive late), what is known in the tourism market as a No Show will occur and you will not have the right to demand a full or partial refund of the amount. If you are not going to use your reservation in whole or in part, or if you are going to arrive late to use your reservation, we recommend that you notify COZUMELITOS TOURS in advance to find out the applicable restrictions.
  1. WHAT IS THE PROCEDURE IN CASE OF QUERIES OR CLAIMS?: In the event that you need to make a claim and/or inquiry, request modifications and/or cancellations (as long as your rate allows it), request the resending of vouchers or tickets, and/or download your invoice, you can access the "My Account" link 24 hours a day if you are registered on the Platform (or through "My Reservation" or "My Trips") with your Purchase Request number, where you can carry out any management. Remember that COZUMELITOSTOURS.COM is an intermediary platform and, as such, its primary means of contact is its online Platform. Regardless, for any emergency, you always have WhatsApp lines that appear in the emails and/or vouchers sent with each Tourist Service.

h. If you wish to make a claim, suggestion, or inquiry, it is recommended that you provide a detailed description of the events, immediately attaching a copy of the supporting documents, explaining what happened and stating your desired solution in clear and simple terms. This way, we can review your case more quickly and efficiently. COZUMELITOSTOURS.COM will analyze the claim and respond to the email address you provided as soon as possible. If the review of the background information determines that the claim should be accepted in whole or in part, COZUMELITOSTOURS.COM will notify you and send you the corresponding agreement by email. This is without prejudice to the fact that COZUMELITOSTOURS.COM may offer you an alternative solution , different from the requests you have made.

  1. If you agree to COZUMELITOS TOURS ' proposal, you must sign the corresponding agreement and send it to COZUMELITOS TOURS at the address provided. Once COZUMELITOS TOURS has received the document, a customer service agent will contact you to inform you of the payment date and other conditions of compliance with the agreement.
  1. Changes or cancellations of reservations made through us, while governed by the Tourism Service Providers, must be managed through COZUMELITOS TOURS . In any of the above cases, the airline and/or the Provider will refer the matter to us.

Please be aware that each Provider has its own regulations for the provision of its Tourism Services. When reviewing these regulations, without prejudice to other matters of interest, please pay attention to the following points:

CHAPTER 5 – ACTIVITIES AND TRANSFERS

Please be aware that each tour operator (the “Operator(s)”) has its own service regulations and rates applicable to the activities, excursions, transfers, tickets and attractions they provide (the “Activity(ies)”).

  • SCHEDULES: Notwithstanding the specific schedules reported for each activity, the opening and closing times of some attractions vary depending on the time of year. It is advisable to contact the attraction in question before visiting to confirm the schedules applicable to your planned date. Please note that the schedules shown on the voucher are in the local time zone of your destination.
  • CONTACT WITH THE OPERATOR : In some cases, you will be asked to contact the Operator prior to the date of use of the Activity or Transfer to confirm some details and/or coordinate the meeting point and/or request the definitive vouchers without which you will not be able to use it. If you do not make this contact in a timely manner and, as a result, your use and enjoyment of the service is frustrated, COZUMELITOS TOURS will not be held responsible and you will not have the right to demand any refund from COZUMELITOS TOURS and/or the Operator.

0.3 RISKY ACTIVITIES : In cases where the contracted Activity is a risky activity, you assume the risk of participating in the Activity and you declare that you are healthy, in good physical and mental health, and properly trained to participate in that Activity. You hereby accept and assume full responsibility for any and all risks of illness, injury, or death (not due to careless, premeditated, or fraudulent conduct) that may occur during the development of the Activity.

5.4 RESPONSIBILITY : COZUMELITOS TOURS will not be responsible for the conditions of the attractions or places, nor for acts of commission or omission by third parties in any Activity, place or service.
